Discovery

If you do your action correctly, there is no discovery.

The reason is that all of the evidence has been included with the original action. There is no further evidence to present.

Discovery is a tool used in equity because equity courts allow a complaint to be filed without showing the evidence. The opposition must use discovery to see evidence that would otherwise remain hidden until the day of the trial.

The best that the opposition can do is to make a "motion in limine" to block the presentation of previously unseen evidence in a trial.
